According to TIP Mexico, one of the main challenges for Mexican fleets operating to the United States is that compliance with NOMs does not guarantee legal circulation in US territory, so the units must also align with the requirements of the Department of Transportation (DOT) , the Federal Motor Carrier Safety Administration (FMCSA) and the National Highway Traffic Safety Administration (NHTSA).

“Monterrey is the epicenter of logistical dynamism to the north.
The company presented a regulatory equivalence matrix to explain the requirements faced by carriers in cross-border operations. Among these, it highlighted NOM-035-SCT, related to manufacturing specifications; NOM-068-SCT-2-2014 , focused on physical and mechanical conditions; and NOM-012-SCT regarding weights and dimensions.

Mexico climbed six positions in the Foreign Direct Investment (FDI) Confidence Index compiled by the consultancy Kearney , moving from 25th place last year to 19th in 2026. This advance places it as the second fastest-growing country in the ranking , only behind Singapore, and in fifth place among emerging markets.

During the presentation of the indicator, Gerardo Rocha, managing partner of Kearney Mexico, highlighted that the United States maintains its first-place ranking, followed by Canada and Japan, while China occupies fourth position . For the first time in 13 years, Asia surpasses Europe in participation, with 10 countries included in the ranking compared to nine European countries.

In the exclusive ranking of emerging markets, Mexico ranks fifth, behind China, the United Arab Emirates, Saudi Arabia, and Brazil . Among the strengths highlighted by investors are the ease of doing business (31%) and the skilled workforce (28%).

Rocha also noted that industrial policy remains a key factor for investors when deciding where to allocate their capital . In fact, 84% of the investors surveyed considered this factor to be “very important” or “extremely important” when making their investment decisions.

“Another issue is which of these industrial policy options are most welcomed by investors, and which are not as positively received. We can see that among those that are much better rated is everything related to infrastructure development. When industrial policy includes infrastructure development, it leads to greater attraction for foreign direct investment,” he noted.

However, he indicated that challenges remain in maintaining competitiveness in key industrial sectors, especially in light manufacturing. To consolidate progress, it will be essential to promote technological innovation, improve regulatory efficiency, and strengthen the domestic economy .

He also noted that among the macroeconomic risks, geopolitical tensions persist (36%) , commodity price increases (30%), and political instability in developed markets (30%).

Rocha also noted that investors demand greater legal certainty and protection of property rights. Public-private partnerships and regional integration, such as the renegotiation of the United States-Mexico-Canada Agreement (USMCA), will be crucial for securing long-term investments .

Furthermore, the executive noted that the most attractive industries for investment in Mexico are telecommunications, aerospace and defense, transportation, and private goods; he also indicated that the integration of supply chains in North America and the nearshoring trend reinforce its attractiveness in an uncertain global economy.

The report produced by Kearney has been conducted since 1998 and is based on surveys of more than 500 CEOs and directors of the world’s leading companies, all with a turnover exceeding $500 million.

Mexico’s export sector is experiencing financial relief after the U.S. Supreme Court declared unconstitutional the tariffs imposed in 2025 by President Donald Trump under the International Emergency Economic Powers Act (IEEPA) . The Court’s decision, issued on February 20, represents a respite for supply chains .

In an interview with T21, Arturo Gómez Marín, senior manager of Customs and Foreign Trade at CGA Customs Consulting , explained that the IEEPA tariffs severely impacted the cash flow and logistics planning of key industries such as automotive, steel and aluminum for more than a year.

The specialist explained that the prior uncertainty generated operating cost overruns of between 25% and 35%, as well as a halt in the flow of goods at the northern border, which affected profit margins . He indicated that the return, a consequence of the ruling, is a good opportunity to improve workflow.

“In Mexico, it’s very common to have tariff recovery processes, I would say even more so than in the United States. Some say: whatever is lost is already a gain. Excuse the expression, but there are companies that were depleted of capital by these tariffs , so the opportunity to recover them is a source of work,” he emphasized.

To manage the returns, Gómez Marín explained that the United States Customs and Border Protection (CBP) will implement an automated web portal for importers and customs brokers.

He estimated that the amount in dispute totals 166 billion dollars (USD) , corresponding to payments actually made during the period of validity of the IEEPA tariffs, that is, from February 1, 2025 to February 20, 2026.

Arturo Gómez Marín, Senior Manager of Customs and Foreign Trade at CGA.

He noted that the validation process will be rigorous, so he believes that companies requesting a refund must accurately demonstrate the origin of their goods and the integrity of their manufacturing records.

“Their files must be thoroughly reviewed, they must be very sure of the origin of the raw materials, and I would even say packaging, packing, labor, energy and all associated costs, so that they are very sure that they will be able to recover the tariff,” he warned.

He indicated that the success of the claims will depend on whether the tariffs have been paid and whether they are under suspension or temporary regimes .

“CBP estimates approximately 300,000 simultaneous applications because that’s a lot. We have to consider that it’s roughly a year of operation, and we also have to remember that the United States is one of Mexico’s main trading partners,” he added.

In this process of tariff refunds, Gómez Marín recommended that companies seek external technical and legal advice to correctly integrate the required documentation given the complexity of the procedure.

It is worth remembering that on February 20, the United States Supreme Court ruled, with six votes in favor and three against, that the tariffs imposed through IEEPA were unconstitutional, considering that Trump exceeded his powers.

According to the U.S. Constitution, the power to regulate foreign trade belongs to Congress , so the Executive branch can only exercise powers in this matter to the extent that they have been delegated to it by legislation.

According to the International Air Transport Association (IATA) , capacity, measured in available cargo tonne-kilometers (ACTK), also increased, registering a 3.6% year-on-year rise.

“Air cargo demand got off to a strong start in 2026. Regionally, the story is more polarized. Airlines in Africa, the Middle East, Asia-Pacific, and Europe reported faster-than-average growth. In contrast, carriers in the Americas reported aggregate contractions,” said Willie Walsh, IATA’s Director General.

However, he said that the resilience of air cargo will continue to be tested in the coming months, a situation that will be addressed at the upcoming IATA Global Cargo Symposium in Lima, Peru, which will take place from March 10 to 12 , “where strengthening the adaptability and efficiency of air cargo through digitalization and other measures will be a key focus.”
