<p><strong><span>25% tariffs on imported Mexican products</span></strong><span> , as well as a similar rate on steel and aluminum by the United States, the </span><a href="https://www.gob.mx/se"><span>Ministry of Economy (SE) relaunched the </span></a><strong><span>“Made in Mexico”</span></strong><span> label , in order to </span><strong><span>promote and strengthen national products</span></strong><span> .</span></p>
<p><span>As part of the </span><strong><span>Mexico Plan</span></strong><span> , which contemplates national and foreign investments, and includes around two thousand specific projects aimed at strengthening strategic sectors, improving competitiveness and promoting sustainable development, the </span><strong><span>“Made in Mexico”</span></strong><span> certification brand was also relaunched .</span></p>
<p><span>According to the </span><a href="https://dof.gob.mx/"><span>Official Gazette of the Federation (DOF)</span></a><span> , any product whose manufacture, manufacturing or assembly has been done in Mexico, and has quality and excellence standards that enhance the identity and reputation of the origin of its raw materials, will be able to access the </span><strong><span>emblematic seal</span></strong><span> , which will be </span><strong><span>valid for five years</span></strong><span> .</span></p>
<p><span>On February 17, the DOF published the new rules for the use of these brands, which, emphasized </span><strong><span>Marcelo Ebrard</span></strong><span> , head of the SE, means  </span><strong><span>projecting a competitive and united country</span></strong><span> , and its wide promotion is due to the current environment of uncertainty in international trade.</span></p>
<blockquote><p><span>&#8220;The purpose of all this effort is for Mexico to move forward, for Mexico to overcome anything that may come our way, for us to be united, cohesive and to project our country,&#8221; the federal official stressed.</span></p></blockquote>
<p><span>According to the rules for the authorization of use of certification marks, these will be granted through the </span><strong><span>Regulatory, Competitiveness and Competition Unit</span></strong><span> of the Ministry of Economy.</span></p>
<p><span>In addition, the DOF stated, “the Honorary Promoter Council “Made in Mexico” is created as an advisory body made up of representatives of the Mexican business, industrial and creative sectors, in accordance with the operating rules issued by this collegiate body.”</span></p>
<blockquote><p><span>To obtain certification, applicants must </span><strong><em> </em></strong><span>“reliably demonstrate that, in the manufacturing or fabrication process, they implement affirmative actions regarding compliance with one or more of the Sustainable Development Goals of the 2030 Agenda on Sustainable Development.”</span></p></blockquote>
<p><span>The </span><strong><span>federal government</span></strong><span> may grant authorization for the use of certification marks within a </span><strong><span>period of up to 10 business days</span></strong><span> after the application is submitted.</span></p>
<blockquote><p><span>Among the obligations of companies that are granted permission to use the logo are that they must “refrain from registering the certification marks in their entirety or any of their parts, whether as a main element or as part of a set, in trademark registries or any other form of intellectual property protection, or as an Internet domain name.”</span></p></blockquote>
<p><span>Also, “certification marks must be used in a way that does not damage the reputation or mislead consumers about the characteristics of the products to which they apply.”</span></p>
<p><span>As part of the sanctions for </span><strong><span>misusing the badge , </span></strong><strong><span>the authorization</span></strong><span> must be cancelled , so they must remove it within  </span><strong><span>10 business days</span></strong><span> at the latest , from all types of documents, websites or other applications where it has been incorporated, as well as avoid using it in their products.</span></p>
<p><strong><span>A logo that has transcended time</span></strong></p>
<p><strong><span>The “Made in Mexico” label was created by designer Omar Arroyo in 1978</span></strong><span> , and is a symbol that has been part of national products in Mexico and abroad and has remained in the collective imagination.</span></p>
<p><span>According to the DOF, on </span><strong><span>March 8, 1978,</span></strong><span> the </span><strong><span>Notice to Industrialists, Merchants and the General Public on the Official Standard NOM-Z-9-1978</span></strong><span> , emblem called Made in Mexico, was published in the Official Gazette of the Federation, with the purpose of establishing and describing said distinctive.</span></p>
<p><span>According to the same document, on </span><strong><span>November 22, 2018 , the </span></strong><strong><span>Agreement establishing the conditions and requirements for granting the authorization and use of the Made in Mexico emblem</span></strong><span> was published in the DOF , in order to establish the requirements for granting the use of said logo and its design, as a mixed brand owned by the Ministry of Economy.</span></p>
<p><span>Currently, </span><strong><span>the brand has the silhouette of an eagle head in white on a maroon background</span></strong><span> . Above the head, it has the phrases “Hecho en” and “Made in” and below it, “México” and “Mexico”. The design is minimalist and identifies Mexican products in the national and international market.</span></p>
<p><span>Although the logo has undergone modifications, such as in 2004 when the eagle changed and an MX was added, or in 2009 when the design of the plumage and the shape of the eagle&#8217;s beak were changed, </span><strong><span>the logo has remained in the Mexican imagination as a symbol of identity</span></strong><span> .</span></p>
<p><span>The relaunch of the brand takes place in a context of uncertainty in world trade, especially due to the protectionist policy that </span><strong><span>Donald Trump</span></strong><span> , president of the United States, seeks to impose with the collection of </span><strong><span>25% tariffs on Mexico</span></strong><span> , which was paused for a month.</span></p>

<p><span>With this measure, residents of the northern strip of Mexico will be able to import these types of cars under certain conditions until November 2025, according to the decree of the </span><a href="https://www.gob.mx/"><span>Government of Mexico</span></a><span> , headed by </span><strong><span>Claudia Sheinbaum</span></strong><span> , which contemplates that passenger </span><strong><span>vehicles</span></strong><span> , </span><strong><span>freight transport units</span></strong><span> , </span><strong><span>road tractors</span></strong><span> , </span><strong><span>semi-trailers and concrete mixer trucks</span></strong><span> may enter the country , as long as their model year is eight to nine years old.</span></p>
<p><span>According to the document, vehicles whose model year is five to nine years prior to the year in which the import is made will have a </span><strong><span>tariff of 1%</span></strong><span> , and those whose model year is 10 years prior to the year in which the import is made, the tariff will be </span><strong><span>10 percent</span></strong><span> .</span></p>
<blockquote><p><span>“The definitive import that importers may opt for in terms of this article will be carried out in accordance with the procedure established by the </span><a href="https://www.sat.gob.mx/home"><span>Tax Administration Service</span></a><span> through general rules. The customs document with which said import is carried out may only cover one vehicle,” the decree states.</span></p></blockquote>
<p><span>According to the rules, in the definitive importation into the country of used vehicles under preferential tariff treatment provided for in the free trade treaties and trade agreements of which Mexico is a party, </span><strong><span>the importer will comply with the formalities and requirements established by said regulations</span></strong><span> .</span></p>
<p><span>It indicates that the owners of imported vehicles must comply with the registration procedure established in the </span><strong><span>Public Vehicle Registry Law</span></strong><span> and other applicable provisions on the matter. In addition, it specifies that the customs document used for importing may only cover one vehicle.</span></p>
<blockquote><p><span>&#8220;The importer must present to the customs authority the valid certificate of origin or the document proving origin at the time of importation,&#8221; it states.</span></p></blockquote>
<p><span>Among other points, the decree specifies that used vehicles </span><strong><span>whose circulation is restricted or prohibited</span></strong><span> in the country of origin due to their characteristics or technical reasons may not be imported , as well as those cars that do not comply with the physical-mechanical or environmental protection </span><strong><span>conditions established by the Mexican authorities, and those that </span></strong><strong><span>have been reported stolen</span></strong><span> .</span></p>
<p><span>It is worth remembering that </span><strong><span>on September 30, the regulation on used cars expired</span></strong><span> and </span><strong><span>on November 5 of this year its validity was resumed until November 2025</span></strong><span> , after said decree was published in the DOF, with which used cars will be able to enter the country to reduce &#8220;the inequality gaps of the population, through access to a decent means of transportation.&#8221;</span></p>
<p><span>Regarding the decree, the </span><a href="https://www.amda.mx/"><span>Mexican Association of Automobile Distributors (AMDA)</span></a><span> stated that “it is the appropriate mechanism to have a legal and orderly trade in used vehicles.”</span></p>
<blockquote><p><span>&#8220;The decree regulating the definitive import of used vehicles is undoubtedly sensitive to the economic, environmental and fiscal problems that the import of used vehicles implies, and may provide legal security to the importers or owners of this merchandise; a situation for which we express not only our agreement with its content but also our support for its very existence,&#8221; he said in a statement.</span></p></blockquote>
<p><strong><span>The organization reiterated its call to the federal government to end the regularization of “automotive smuggling</span></strong><span> ,” which was extended by former President </span><strong><span>Andrés Manuel López Obrador</span></strong><span> until September 30, 2026, and which, at the time, the AMDA described as “regrettable,” since it inhibits the sale of new cars in Mexico.</span></p>

<p><span style="font-weight: 400;">The recent publication in the Official Gazette of a decree issued by the <a href="https://www.gob.mx/asea/">National Agency of Industrial Safety and Environmental Protection in the Hydrocarbons Sector (ASEA)</a> has shaken the foundations of the Mexican energy sector, as it introduces <strong>substantial changes in the &#8220;administrative provisions&#8221;</strong> regulating mandatory insurance for companies operating in the hydrocarbon and petroleum sphere.</span></p>
<p>&nbsp;</p>
<p><span style="font-weight: 400;">However, more than just a regulatory adjustment, these modifications <strong>represent a radical shift in the way corporate responsibility is conceived in this sector.</strong></span></p>
<p>&nbsp;</p>
<p><span style="font-weight: 400;">One of the main <strong>novelties of this decree</strong> is the <strong>elimination of minimum coverage</strong> amounts for insurance policies. Until now, regulated companies were subject to predefined liability limits, which in many cases resulted in excessive financial burden.</span></p>
<p><span style="font-weight: 400;">By <strong>allowing companies to determine their own coverage limit</strong>s, either in collaboration with insurance institutions or independently, they are provided with greater flexibility to adapt to their specific needs and circumstances.</span></p>
<p><span style="font-weight: 400;">However, this freedom does not come without its corresponding responsibilities.</span></p>
<blockquote><p><span style="font-weight: 400;">In this regard, Marcial Díaz Ibarra, from <a href="https://www.quaenergy.mx/">QUA Energy</a>, commented to T21 that &#8220;the relevant aspects of the decree are two, the obligation to have an insurance policy for the activity carried out and that the regulated entity is responsible for the risk generated even if the amount is greater than the one insured.&#8221;</span><img decoding="async" class="aligncenter" src="https://t21.com.mx/wp-content/uploads/2024/05/Captura-de-pantalla-2024-05-22-182549.jpg" width="326" height="330" /></p></blockquote>
<p><span style="font-weight: 400;">Furthermore, he explained that these provisions are necessary &#8220;<strong>to provide certainty to the areas where the regulated installations</strong> are located. The State cannot do it alone, and it is the obligation of the regulated entity to cover the damages caused.&#8221;</span></p>
<p><span style="font-weight: 400;">He added that these provisions represent a significant change in the way regulated companies manage their risks and responsibilities.</span></p>
<blockquote><p><span style="font-weight: 400;">&#8220;Previously, they were limited by the minimum coverage amounts established, which sometimes did not fully reflect the level of risk involved in their operations. Now, with the freedom to determine the liability limits in their insurance policies, these companies can better tailor their risk management strategies to the specifics of their activities. This gives them greater flexibility to mitigate risks and protect both companies and the environment more effectively,&#8221; Marcial Díaz noted.</span></p></blockquote>
<p><span style="font-weight: 400;">Regarding future improvements in the regulatory framework of the sector, <strong>Díaz suggested the implementation of a one-stop shop for handling procedures</strong>, which would significantly reduce regulatory burden by avoiding the repetition of processes with different agencies.</span></p>
<p><span style="font-weight: 400;">These modifications represent progress towards a more efficient and transparent regulatory framework in the hydrocarbons sector in Mexico, with significant impacts on both company operations and environmental protection and operational safety.</span></p>
